Invalid <em>Sekhakh<\/em> and Gaps in the <em>Sekhakh<\/em>"},"content":{"rendered":"<p>If there is a patch of invalid <em>sekhakh<\/em>, made of plastic, for example, in the middle of kosher <em>sekhakh<\/em>, or if there is a concrete beam that invalidates the <em>sekhakh<\/em> underneath it, then if the invalid <em>sekhakh <\/em>is wider than 4 <em>tefa\u1e25im<\/em> (c. 30 cm), one may not sit underneath it. If the invalid <em>sekhakh<\/em> is less than 4 <em>tefa\u1e25im<\/em> but more than 3 (c. 22 cm), <em>le-khat\u1e25ila<\/em> one should not sit or sleep underneath it, but in a time of need one may do so (MB 632:3). If the invalid <em>sekhakh <\/em>is less than 3 <em>tefa\u1e25im<\/em> wide, one may eat or sleep there even <em>le-khat\u1e25ila<\/em>, because it is rendered null vis-\u00e0-vis the <em>sukka<\/em>.<\/p>\n<p>If there is an empty gap in the <em>sekhakh<\/em>, the laws pertaining to it are more stringent, since this is more discernible than invalid <em>sekhakh<\/em>. If the width of the gap is 3 <em>tefa\u1e25im<\/em> (c. 22 cm), the area beneath it is not kosher, and one may not sit there. If it is less than 3 <em>tefa\u1e25im<\/em>, it is rendered null vis-\u00e0-vis the <em>sukka<\/em>, and one may sit and sleep there (SA 632:2) as long as neither most of his head nor most of his body are underneath the gap.<sup><a href='#_te01ftn2_16' id='_te01ftnref2_16' class='aup1'>[16]<\/a><\/sup><\/p>\n<p>Let us say that one has a large porch, most of which is roofed, but with a small area, 5 <em>tefa\u1e25im<\/em> wide, under open sky. At first glance, it would seem that there is no way to build a <em>sukka <\/em>there, as a kosher <em>sukka<\/em> must be at least 7 <em>tefa\u1e25im<\/em> wide. However, we have seen that invalid <em>sekhakh<\/em> that is less than 3 <em>tefa\u1e25im<\/em> wide is considered part of the <em>sukka<\/em>, and a person may sit underneath it. A <em>sukka<\/em> can therefore be built on such a porch, as follows: A <em>sukka<\/em> 7 <em>tefa\u1e25im<\/em> wide should be set up at the end of the porch. Since 5 <em>tefa\u1e25im<\/em> of <em>sekhakh<\/em> are under open sky and less than 3 <em>tefa\u1e25im<\/em> are under the roof and invalid, then even those 2 <em>tefa\u1e25im<\/em> are deemed part of the <em>sukka<\/em>, and one may sit and sleep beneath them. This is on condition that he puts up a wall separating the 2 <em>tefa\u1e25im<\/em> of the roofed porch that will be part of the <em>sukka<\/em> from the rest of the porch that will not. This wall must be 7 <em>tefa\u1e25im<\/em> long and preferably should reach the <em>sekhakh<\/em>. One should make a <em>tzurat ha-peta\u1e25 <\/em>along the rest of the border between the <em>sukka<\/em> and the porch. (See <em>\u1e24azon Ovadia<\/em>, p. 12;<em> Min\u1e25at Yitz\u1e25ak<\/em> 6:60:20; <em>Shevet Ha-Levi<\/em> 10:99.)<\/p>\n<div>\n<hr size=\"1\" \/>\n<div>\n<a href='#_te01ftnref2_16' id='_te01ftn2_16'>[16]<\/a>. According to Rabbeinu \u1e24ananel, R. Yitz\u1e25ak ibn Gi\u2019at, <em>Tosafot<\/em>, and Ra\u2019ah, even <em>le-khat\u1e25ila<\/em> one may sit underneath a gap of less than 3 <em>tefa\u1e25im<\/em>. According to Ritva and Ran, one may not have the majority of his head or body under the gap. According to Rosh and Rabbeinu Yeru\u1e25am, the prohibition applies only when the gap extends the length of the <em>sukka<\/em>; this is the ruling of <em>Beit Zevul<\/em> 3:14 and <em>\u1e24azon Ovadia<\/em>, p. 68. I write above to be stringent, but one who wishes to be lenient and follow the Rosh may do so. See <em>Har\u1e25avot<\/em>.<\/p>\n<p>If a gap of 3 or 4 <em>tefa\u1e25im<\/em> of invalid <em>sekhakh<\/em> extends across the <em>sukka<\/em>, effectively dividing it into two <em>sukkas<\/em>, one must make sure that each <em>sukka<\/em> has the requisite three walls (Rema 632:2).<\/p>\n<p>Four <em>tefa\u1e25im<\/em> of invalid <em>sekhakh<\/em> invalidates a large <em>sukka<\/em>, but if a <em>sukka<\/em> is less than 10 <em>tefa\u1e25im<\/em> wide, even 3 <em>tefa\u1e25im<\/em> of invalid <em>sekhakh<\/em> invalidates it.
