{"id":5203,"date":"2010-02-04T11:00:23","date_gmt":"2010-02-04T09:00:23","guid":{"rendered":"https:\/\/ph.yhb.org.il\/en\/?p=5203"},"modified":"2010-02-04T11:00:23","modified_gmt":"2010-02-04T09:00:23","slug":"05-04-11","status":"publish","type":"post","link":"https:\/\/ph.yhb.org.il\/en\/05-04-11\/","title":{"rendered":"11 &#8211; Shaving, Haircuts, Weddings, and Tachanun"},"content":{"rendered":"<p>After <em>Yom HaAtzmaut<\/em> was established as a day of joy and thanksgiving, the question arose: do the customs of mourning that we observe during the <em>Sefirat HaOmer<\/em> period apply to <em>Yom HaAtzmaut<\/em>? The halachic authorities have expressed their opinions in both directions. The accepted practice is not to keep customs of mourning that diminish expressions of the joy. Therefore, it is permissible to dance and play music. However, one should not make a wedding on that day, because avoiding weddings is not considered an expression of mourning that clashes with the joy of <em>Yom HaAtzmaut<\/em>.<\/p>\n<p>Those who shave regularly should shave in advance of <em>Yom HaAtzmaut<\/em>, just like one puts on special clothing before the holiday begins. Regarding haircuts, it seems that only one who looks disgraceful because of his [long] hair may take a haircut prior to <em>Yom HaAtzmaut<\/em>. Someone who looks fine, however, is allowed to take a haircut only on <em>Yom HaAtzmaut<\/em> itself, for then the joy of the day overrides this custom of mourning<sup><a id=\"_ze01fenref4_12\" class=\"aup12\" href=\"#_ze01fen4_1\">12<\/a><\/sup>.<\/p>\n<p>The Chief Rabbinate, under the leadership of Rabbi Unterman and Rabbi Nissim, determined that even Ashkenazim who observe the customs of mourning during the latter part of <em>Sefirah<\/em> should not curtail their joy on the 28<sup>th<\/sup> of <em>Iyar<\/em>, <em>Yom Yerushalayim<\/em>. After all, many communities terminate all the restrictions after <em>Lag BaOmer<\/em> (the 33<sup>rd<\/sup> day of the <em>Omer<\/em>) (see above 3.2-4). This is all the more so, now that the 28<sup>th<\/sup> of <em>Iyar<\/em> has been instituted as a day of thanksgiving and joy over the miracle that <em>HaKadosh Baruch Hu<\/em> performed for His nation, Israel. Therefore, one may even make a wedding on <em>Yom Yerushalayim<\/em>.<\/p>\n<p>We do not say <em>Tachanun<\/em> on <em>Yom HaAtzmaut<\/em>, <em>Yom Yerushalayim<\/em>, or during the <em>Minchah<\/em> service preceding these days (<em>Peninei Halachah<\/em>, <em>Tefillah<\/em> 21.7; see also 21.2, n. 1).<\/p>\n<div>\n<hr size=\"1\" \/>\n<div>\n<p><a id=\"_ze01fen4_12\" href=\"#_ze01fenref4_12\">[12]<\/a> <em>Rishon Letzion<\/em>, Sefardic Chief Rabbi Yitzchak Nissim, writes (<em>Hilchot Yom HaAtzmaut VeYom Yerushalayim<\/em>, pp. 334-40) that all customs of mourning are canceled on <em>Yom HaAtzma\u2019ut<\/em>. He bases his ruling on those <em>poskim<\/em> who hold that one who has not yet fulfilled the <em>mitzvah<\/em> of procreation may get married during <em>Sefirah<\/em> (<em>Radvaz<\/em>, <em>Pri Chadash<\/em>). Similarly, some people take haircuts in honor of <em>Shabbat<\/em> and <em>Rosh Chodesh<\/em> (<em>Radvaz<\/em>, <em>Ya\u2019avetz<\/em>). Furthermore, Rabbi Chayim Palagi writes (<em>Mo\u2019ed LeChol Chai<\/em> 6) that a miracle happened to some of the people of his city on the eighth of <em>Iyar<\/em>, and to others on the eleventh, and they take haircuts on these days. These are Rabbi Nissim\u2019s proofs. There is even more room for leniency when it comes to shaving, because shaving is not festive in nature; it simply eliminates the mournful appearance, as we explained above (3.7). The author of <em>Responsa Yaskil Avdi<\/em> (6:10), on the other hand, does not permit haircuts or weddings on <em>Yom HaAtzmaut<\/em>. Our master and teacher, HaRav Tzvi Yehuda HaKohen Kook, used to rebuke those students who usually shave but look like mourners on <em>Yom HaAtzmaut<\/em>, saying, \u201cTheir countenance testifies against them <span style=\"font-size: xx-small\">(cf. <span style=\"font-size: xx-small\"><em>Yeshayah<\/em><span style=\"font-size: xx-small\"> 3:9) that they are not happy and that they do not truly thank <em>Hashem<\/em> for the miracle.\u201d See Rabbi Shmuel Katz\u2019s essay in <em>HaRabbanut HaRashit<\/em>, vol. 2, pp. 877-82. <\/span><\/span><\/span><\/p>\n<p><strong>Regarding mourners<\/strong>, Rabbi Katz\u2019s abovementioned book (p. 900, n. 37) cites a responsa from Rabbi Goren, ruling that, similar to <em>Chanukah<\/em>, the holidays of <em>Yom HaAtmaut<\/em> and <em>Yom Yerushalayim<\/em> do not cancel <em>shiv\u2019ah<\/em> (the seven day period of mourning for a close relative). Therefore, a mourner does not recite <em>Hallel<\/em>, nor is <em>Hallel<\/em> said by others in a house of mourning, rather elsewhere. If the mourner has completed <em>shiv\u2019ah<\/em>, he should join the festive prayers and celebrations, as long as there is no live music.
