{"id":5489,"date":"2011-03-04T03:02:38","date_gmt":"2011-03-04T01:02:38","guid":{"rendered":"https:\/\/ph.yhb.org.il\/en\/?p=5489"},"modified":"2021-03-15T12:59:03","modified_gmt":"2021-03-15T10:59:03","slug":"04-03-02","status":"publish","type":"post","link":"https:\/\/ph.yhb.org.il\/en\/04-03-02\/","title":{"rendered":"02.\u00a0The Prohibition against <strong>\u1e24ametz<\/strong> One Owns"},"content":{"rendered":"<p>The prohibition against <strong>\u1e25ametz<\/strong> on Pesa\u1e25 is unique in that it is not only forbidden to eat it, but it is forbidden even to keep; whoever keeps it in his home violates the two prohibitions of <strong>bal yera\u2019eh<\/strong> and <strong>bal yimatzei<\/strong>.<sup><a href='#_te01ftn3_2' id='_te01ftnref3_2' class='aup1'>[2]<\/a><\/sup><\/p>\n<p>The Torah\u2019s language, \u201cno <strong>\u1e25ametz<\/strong> <strong>of yours<\/strong> shall be seen, and no <strong>se\u2019or<\/strong> <strong>of yours<\/strong> shall be seen within all your borders\u201d (Shemot 13:7), shows that there is no prohibition against a Jew having a gentile\u2019s <strong>\u1e25ametz<\/strong> or ownerless <strong>\u1e25ametz<\/strong> in his domain. It says \u201c<strong>of yours<\/strong>\u201d \u2013 you are not allowed to see <strong>\u1e25ametz<\/strong> that belongs to you specifically, implying that the <strong>\u1e25ametz<\/strong> of gentiles and <strong>\u1e25ametz<\/strong> that is ownerless are permissible.<\/p>\n<p>Therefore, if a gentile lives in a Jew\u2019s courtyard, even if the gentile works for the Jew, the Jew does not have to eliminate the gentile\u2019s <strong>\u1e25ametz<\/strong>. Likewise, if a gentile deposited <strong>\u1e25ametz<\/strong> in a Jew\u2019s house for safekeeping before Pesa\u1e25, the Jew need not clear it out, as long as he is not responsible for the <strong>\u1e25ametz<\/strong>. However, he must erect a partition at least ten <strong>tefa\u1e25im <\/strong>(handbreadths) high in front of the <strong>\u1e25ametz<\/strong>, to make certain that he does not forget and eat of it (SA 440:2). Alternatively, he may lock it up and hide the key, or close it in a cabinet and tape the doors shut, so that if someone opens them, he will be reminded of the prohibition against <strong>\u1e25ametz<\/strong>.<\/p>\n<p>A Jew may also permit a gentile enter his home on Pesa\u1e25, carrying his <strong>\u1e25ametz<\/strong> with him. It is forbidden, though, for the Jew to eat with the gentile at the same table, lest the Jew forget and eat of the gentile\u2019s <strong>\u1e25ametz<\/strong>. Even if he puts something on the table to remind himself not to eat from the gentile\u2019s <strong>\u1e25ametz<\/strong>, he may not eat with the gentile at one table, lest a crumb of <strong>\u1e25ametz<\/strong> may get mixed into the Jew\u2019s food. Once the gentile has finished heating, the Jew may clean the table thoroughly of all the <strong>\u1e25ametz<\/strong> crumbs and then eat there (SA 440:3; MB <strong>ad loc. <\/strong>18).<\/p>\n<div>\n<hr size=\"1\" \/>\n<div>\n<a href='#_te01ftnref3_2' id='_te01ftn3_2'>[2]<\/a>. According to Rosh (<strong>Pesa\u1e25im <\/strong>1:9), any <strong>\u1e25ametz<\/strong> that can be seen, even if in reality it is not seen, would cause a violation of <strong>bal yera\u2019eh<\/strong>. It turns out then, that anyone who is in possession of at least an olive-sized piece of <strong>\u1e25ametz<\/strong> violates two prohibitions: <strong>bal yera\u2019eh <\/strong>and<strong> bal yimatzei<\/strong>.
