{"id":5499,"date":"2011-03-04T03:06:13","date_gmt":"2011-03-04T01:06:13","guid":{"rendered":"https:\/\/ph.yhb.org.il\/en\/?p=5499"},"modified":"2026-03-15T10:34:55","modified_gmt":"2026-03-15T08:34:55","slug":"04-03-06","status":"publish","type":"post","link":"https:\/\/ph.yhb.org.il\/en\/04-03-06\/","title":{"rendered":"06.\u00a0When the Prohibitions of Eating and Benefiting from <strong>\u1e24ametz<\/strong> Begin"},"content":{"rendered":"<p>The mitzva of eliminating <strong>\u1e25ametz<\/strong> must be carried out by midday of the 14th of Nisan<strong>.<\/strong> Every instant that a Jew keeps his <strong>\u1e25ametz<\/strong> after that time he is in violation of the positive commandment to remove the <strong>\u1e25ametz<\/strong>. Beginning at midday, the Torah prohibition against eating and gaining benefit from <strong>\u1e25ametz<\/strong> begins as well (MT, Laws of <strong>\u1e24ametz <\/strong>and Matza 1:8; above, section 1 of the present chapter).<\/p>\n<p>As discussed above (2:2), in order to distance one further from possibly violating commandments, the Sages added to the prohibitions and forbade gaining benefit from <strong>\u1e25ametz<\/strong> for an additional hour. They also forbade eating <strong>\u1e25ametz<\/strong> for two extra hours, since on a cloudy day people are likely to err by as much as two hours.<\/p>\n<p>These times are calculated by dividing the day into twelve equal parts, each of which is called \u201ca seasonal hour\u201d (\u201c<strong>sha\u2019ah zemanit<\/strong>\u201d). It is forbidden to eat <strong>\u1e25ametz<\/strong> from the beginning of the fifth hour; it is forbidden to gain any benefit from the <strong>\u1e25ametz<\/strong> from the beginning of the sixth hour; and the Torah prohibition against eating and benefiting from <strong>\u1e25ametz<\/strong> begins from the beginning of the seventh hour.<\/p>\n<p>Thus, in practice, it is permissible to eat <strong>\u1e25ametz<\/strong> throughout the first four hours of the 14th day of Nisan. During the fifth hour, it is forbidden to eat <strong>\u1e25ametz<\/strong> by rabbinic decree, but it is still permissible to benefit from the <strong>\u1e25ametz<\/strong> \u2013 for example, one may feed <strong>\u1e25ametz<\/strong> to an animal or sell it to a gentile. With the onset of the sixth hour of the day, it becomes forbidden by rabbinic decree to gain benefit from the <strong>\u1e25ametz<\/strong>, and it is consequently no longer considered in his possession, and he can no longer sell it to a gentile or nullify it. The only way to eliminate it is to burn it, crumble it, and throw it into the sea, or scatter it to the wind (SA 443:1).<\/p>\n<p>The <strong>poskim<\/strong> disagree about when to calculate the beginning of the day. <strong>Magen Avraham <\/strong>maintains that it begins at dawn, that is, from when the first light becomes visible in the east. The Vilna Gaon maintains that it begins at sunrise, that is, from the time when the sun itself becomes visible in the east. The difference between dawn and sunrise is more than an hour; thus, for every <strong>halakha<\/strong> contingent on the hours of the day, calendars list two times. The earlier one in the morning is based on the approach of <strong>Magen Avraham<\/strong>, and the later one accords with the Vilna Gaon\u2019s approach. This is true concerning the recitation of the morning <strong>Shema<\/strong>, which must be done by the end of the first three hours of the day, and it is also true of the <strong>Sha\u1e25arit<\/strong> prayer, whose set time is until the end of the fourth hour (<strong>Peninei Halakha: Prayer<\/strong> 11:10, n. 14).<\/p>\n<p>In practice, since the final times for eating and benefiting from <strong>\u1e25ametz<\/strong> are of rabbinic origin, as are the sale and <strong>bitul<\/strong> of <strong>\u1e25ametz<\/strong>, the <strong>halakha<\/strong> follows the more lenient view, since in cases of doubt on matters of rabbinic origin the <strong>halakha<\/strong> follows the lenient view. Nevertheless, it is better to be stringent when possible (MB 443:8).<sup><a href='#_te01ftn3_9' id='_te01ftnref3_9' class='aup1'>[9]<\/a><\/sup><\/p>\n<div>\n<hr size=\"1\" \/>\n<div>\n<a href='#_te01ftnref3_9' id='_te01ftn3_9'>[9]<\/a>. A question arises regarding one who is in America and owns <strong>\u1e25ametz<\/strong> in Eretz Yisrael: Until when can he annul or sell his <strong>\u1e25ametz<\/strong>? The end of the fifth hour where the <strong>\u1e25ametz <\/strong>is, or the end of the fifth hour where the owner is, about seven hours after the last time for annulling <strong>\u1e25ametz <\/strong>in Eretz Yisrael? According to most <strong>poskim<\/strong>, we follow the location of the person, although there are some who maintain that one should follow the location of the <strong>\u1e25ametz<\/strong>. <strong>Le-khat\u1e25ila <\/strong>one should follow the earlier time, but <strong>be-di\u2019avad <\/strong>we follow the location of the person. This is the view of <strong>Igrot Moshe <\/strong>O\u1e24 4:94-95. See also <strong>Piskei Teshuvot<\/strong> 443:1.<\/p>\n<p>The first opinion is quoted in the name of MA, even though the author himself was unsure.
