{"id":5529,"date":"2011-03-04T04:13:40","date_gmt":"2011-03-04T02:13:40","guid":{"rendered":"https:\/\/ph.yhb.org.il\/en\/?p=5529"},"modified":"2021-03-21T09:14:40","modified_gmt":"2021-03-21T07:14:40","slug":"04-04-13","status":"publish","type":"post","link":"https:\/\/ph.yhb.org.il\/en\/04-04-13\/","title":{"rendered":"13.\u00a0Synagogue, Dormitory, and Yeshiva"},"content":{"rendered":"<p>Synagogues and <strong>batei midrash <\/strong>(Torah study halls) require <strong>bedikat \u1e25ametz<\/strong> on the night of the 14th, because people sometimes eat <strong>\u1e25ametz<\/strong> in them. This is true even of synagogues where people generally do not eat, for children sometimes enter them with <strong>\u1e25ametz<\/strong> (SA 433:10). However, when it comes to saying a <strong>berakha<\/strong> over this search, there is some uncertainty. Therefore, it is best that the person responsible for searching the <strong>beit knesset<\/strong> first search his own home, and when saying the <strong>berakha<\/strong> there, intend to include the synagogue.<sup><a href='#_te01ftn4_9' id='_te01ftnref4_9' class='aup1'>[9]<\/a><\/sup><\/p>\n<p>Boys and girls living in a dormitory and paying for this facility have the status of tenants, and if a <strong>kezayit<\/strong> of <strong>\u1e25ametz<\/strong> remains in their room during Pesa\u1e25 they violate <strong>bal yera\u2019eh <\/strong>and <strong>bal yimatzei<\/strong>. Therefore, they are obligated to search their rooms before Pesa\u1e25. If they will be staying there during Pesa\u1e25, they are required to search on the night of the 14th with a <strong>berakha<\/strong>. If they leave the dormitory a number of days before Pesa\u1e25, they are required to search on the night before they leave, without reciting a <strong>berakha<\/strong>.<sup><a href='#_te01ftn4_10' id='_te01ftnref4_10' class='aup1'>[10]<\/a><\/sup> The responsibility for searching the rest of the rooms and halls in the yeshiva belongs to the yeshiva administration.<\/p>\n<p>One who buys or begins renting a home before Pesa\u1e25 must search it even if he has not yet occupied it, because the previous resident may have left some <strong>\u1e25ametz<\/strong> there. Since the house is in his possession, this <strong>\u1e25ametz<\/strong> will cause him to violate <strong>bal yera\u2019eh <\/strong>and<strong> bal yimatzei<\/strong>. If he owns another house where he will be fulfilling the mitzva of <strong>bedikat \u1e25ametz<\/strong>, he can sell or rent out the new home to a gentile and thus exempt himself from the obligation to search it (see above, section 11).<\/p>\n<div>\n<hr size=\"1\" \/>\n<div>\n<a href='#_te01ftnref4_9' id='_te01ftn4_9'>[9]<\/a>. The opinion of most <strong>poskim<\/strong> is that he should recite the <strong>berakha<\/strong>, since it is a mitzva. See MB 433:43 in the name of SAH<strong>.<\/strong> But AHS 433:12 states that one of the reasons for <strong>bedikat \u1e25ametz<\/strong> is to prevent violation of <strong>bal yera\u2019eh<\/strong>, and since a synagogue does not belong to any one individual, no one would violate <strong>bal yera\u2019eh<\/strong> on any <strong>\u1e25ametz<\/strong> that remains there. Accordingly, there is no mitzva to check the synagogue, and thus no <strong>berakha<\/strong> should be recited. See Maharsham 5:49. Nonetheless, if the synagogue or <strong>beit midrash<\/strong> belongs to one particular individual or to several partners, according to all authorities he\/they must check it with a <strong>berakha<\/strong>. However, if the synagogue owner had already recited the <strong>berakha<\/strong> in his house, he need not recite another <strong>berakha<\/strong> in the synagogue.<\/p>\n<p><a href='#_te01ftnref4_10' id='_te01ftn4_10'>[10]<\/a>. <strong>\u1e24azon Ish<\/strong> ruled for a yeshiva student that even if he would not be in his room over Pesa\u1e25, it is preferable for him to check his room on the night of the 14th with a <strong>berakha<\/strong>. This opinion is quoted in <strong>Sidur Pesa\u1e25 Ke-hilkhato<\/strong> 12:9. Some authorities debate whether the yeshiva student is considered a renter, since the yeshiva administration can switch him to a new room at a whim (see <strong>Piskei Teshuvot<\/strong> 437:4). However, it appears that yeshiva administrations generally do not transfer older students to new rooms without prior agreement. Therefore, this is similar to a standard rental agreement where there are conditions that if breached result in the cancelation or abrogation of the rental agreement.
