{"id":5555,"date":"2011-03-04T06:05:36","date_gmt":"2011-03-04T04:05:36","guid":{"rendered":"https:\/\/ph.yhb.org.il\/en\/?p=5555"},"modified":"2021-03-21T09:33:13","modified_gmt":"2021-03-21T07:33:13","slug":"04-06-05","status":"publish","type":"post","link":"https:\/\/ph.yhb.org.il\/en\/04-06-05\/","title":{"rendered":"05.\u00a0The Deadline for Selling <strong>\u1e24ametz<\/strong> and the Status of One Visiting Eretz Yisrael or Abroad"},"content":{"rendered":"<p>The sale must take place while it is still permitted to derive benefit from <strong>\u1e25ametz<\/strong>, for when the sixth hour of the 14th of Nisan arrives, and it becomes forbidden to derive benefit from <strong>\u1e25ametz<\/strong>, it may not be sold; it must be destroyed. So that people can join the sale until the last day, the sale customarily occurs on the 14th, just before the end of the time that it is permissible to derive benefit from <strong>\u1e25ametz<\/strong>.<\/p>\n<p>The prohibition takes effect according to one\u2019s location. In Eretz Yisrael, the sixth hour arrives approximately seven hours before it arrives on the East Coast of the United States. Therefore, a U.S. resident who is in Israel must sell his <strong>\u1e25ametz<\/strong> in Eretz Yisrael, because if he sells his <strong>\u1e25ametz<\/strong> according to U.S. times, the sale will take place when <strong>\u1e25ametz <\/strong>is already forbidden for him to sell.<\/p>\n<p>At first glance, the end of Pesa\u1e25 also poses a problem for such a person, because he must observe <strong>yom tov sheni shel galuyot <\/strong>(the extra day of Yom Tov observed in the Diaspora; see <strong>Peninei Halakha: Festivals <\/strong>9:8), which means that the prohibition of <strong>\u1e25ametz<\/strong> applies to him until the end of the eighth day, while in Israel the <strong>\u1e25ametz<\/strong> is bought back from the gentile after the seventh day. Nevertheless, he may still sell his <strong>\u1e25ametz<\/strong> in Eretz Yisrael. Even though the gentile sells the <strong>\u1e25ametz<\/strong> back at the end of seven days, since the U.S. resident is still observing Pesa\u1e25 according to the custom of Jews in <strong>\u1e25utz la-aretz<\/strong>, and he is not yet interested in buying the <strong>\u1e25ametz <\/strong>back, the <strong>\u1e25ametz<\/strong> remains <strong>hefker<\/strong> or in the possession of the <strong>beit din<\/strong>. Only after <strong>yom tov sheni shel galuyot<\/strong> has passed does the <strong>\u1e25ametz<\/strong> return to his possession.<\/p>\n<p>If his family remains in America, and they plan to eat the <strong>\u1e25ametz<\/strong> after the prohibition has commenced in Eretz Yisrael, he must renounce ownership of his share of that <strong>\u1e25ametz<\/strong>, and his family sells the <strong>\u1e25ametz<\/strong> there.<\/p>\n<p>A resident of Eretz Yisrael who travels to the U.S. before Pesa\u1e25 may, in principle, sell his <strong>\u1e25ametz<\/strong> in the United States, for, according to most <strong>poskim<\/strong>, the obligation to eliminate <strong>\u1e25ametz<\/strong> depends on the owner\u2019s location, not the location of the <strong>\u1e25ametz. <\/strong>Nevertheless, one should preferably sell it in Eretz Yisrael, in order to satisfy the opinions of all <strong>poskim<\/strong>, for some maintain that one must eliminate <strong>\u1e25ametz<\/strong> according to its location, and, if this is the case, one must sell the <strong>\u1e25ametz<\/strong> before the onset of the prohibition in Eretz Yisrael.<sup><a href='#_te01ftn6_7' id='_te01ftnref6_7' class='aup1'>[7]<\/a><\/sup><\/p>\n<p>Additionally, a resident of Eretz Yisrael who is visiting a Diaspora community should not eat <strong>\u1e25ametz <\/strong>on the eighth day of Pesa\u1e25, just as he should not do any other activity forbidden on Yom Tov, even in private (AHS 596:5). If such a person has his own place of residence, he need not partake in a second Seder. However, if he is being hosted by people who live abroad, he should participate in the second Seder. He should not recite <strong>berakhot <\/strong>on <strong>mitzvot<\/strong>, but instead should answer \u201cAmen\u201d to the <strong>berakhot <\/strong>of others (see <strong>Peninei Halakha: Zemanim<\/strong>, ch. 9, for a thorough treatment of these issues).<\/p>\n<div>\n<hr size=\"1\" \/>\n<div>\n<a href='#_te01ftnref6_7' id='_te01ftn6_7'>[7]<\/a>. <strong>Responsa <\/strong><strong>Oneg Yom Tov<\/strong> (\u00a736) states that we follow the location of the <strong>\u1e25ametz<\/strong>. Many disagree with this ruling and maintain that the prohibition takes effect according to the location of the owner. This is the opinion of <strong>\u1e24esed Le-Avraham <\/strong>\u00a735<strong>, Eretz Tzvi <\/strong>1:83<strong>, <\/strong>and other <strong>poskim<\/strong>. <strong>Le-khat\u1e25ila<\/strong>, we take both opinions into consideration and follow whichever time is earlier, as is written in <strong>Igrot Moshe <\/strong>O\u1e24 4:94-95. The suggestion that a U.S. resident whose family remained in America for Pesa\u1e25 should renounce ownership of his <strong>\u1e25ametz<\/strong> is mentioned in <strong>Sidur Pesa\u1e25 Ke-hilkhato<\/strong> 11:14.<\/p>\n<p>A resident of the Diaspora who is in, and sells his <strong>\u1e25ametz<\/strong> in, Eretz Yisrael should have in mind not to reacquire this <strong>\u1e25ametz<\/strong> until after the eighth day of Pesa\u1e25. However, even if he did not have this intention, <strong>Sidur Pesa\u1e25 Ke-hilkhato<\/strong> 11:35 states that presumably he does not want to reacquire the <strong>\u1e25ametz<\/strong> before the festival ends, so he does not reacquire it until it becomes permissible. <strong>Mikra\u2019ei Kodesh <\/strong>Pesa\u1e25 1:76 states that even if one acquired <strong>\u1e25ametz<\/strong> on the eighth day of Pesa\u1e25 in the Diaspora, the <strong>\u1e25ametz<\/strong> may be eaten after Pesa\u1e25, since there are <strong>poskim<\/strong> who maintain that a Diaspora resident in Eretz Yisrael is not required to observe <strong>yom tov sheni shel galuyot <\/strong>(see <strong>Peninei Halakha: Festivals <\/strong>9:8).
