{"id":5579,"date":"2011-03-04T08:04:32","date_gmt":"2011-03-04T06:04:32","guid":{"rendered":"https:\/\/ph.yhb.org.il\/en\/?p=5579"},"modified":"2021-03-21T10:25:36","modified_gmt":"2021-03-21T08:25:36","slug":"04-08-04","status":"publish","type":"post","link":"https:\/\/ph.yhb.org.il\/en\/04-08-04\/","title":{"rendered":"04.\u00a0Principles of Kosher Supervision on Pesa\u1e25"},"content":{"rendered":"<p>There is a fundamental question regarding the laws of <strong>kashrut<\/strong> on Pesa\u1e25: What is the status of foods that are not normally made with <strong>\u1e25ametz <\/strong>all year round? Are they kosher for Pesa\u1e25 as they are, without any special supervision, or must we consider the possibility that they were somehow mixed with <strong>\u1e25ametz<\/strong> and should not be eaten on Pesa\u1e25?<\/p>\n<p>According to <strong>Shul\u1e25an Arukh<\/strong>, as long as there is no real concern that some <strong>\u1e25ametz<\/strong> fell into this food or that it has absorbed the taste of <strong>\u1e25ametz <\/strong>by being cooked in a pot in which <strong>\u1e25ametz<\/strong> was cooked recently, there is no need to suspect that the food contains <strong>\u1e25ametz<\/strong>.<\/p>\n<p>However, Rema writes that Ashkenazic custom is preferably to avoid eating specific products without special supervision for Pesa\u1e25. This is because <strong>\u1e25ametz<\/strong> is used throughout the year, and we are not generally cautious about it, so we suspect that some of it may have fallen unnoticed into these particular foods. We are also concerned that the foods may have been unwittingly cooked in <strong>\u1e25ametz<\/strong> pots.<\/p>\n<p>In practice, all <strong>kashrut<\/strong> organizations today tend to follow the stringent ruling of Rema and do not certify foods for Pesa\u1e25 unless due caution to avoid <strong>\u1e25ametz <\/strong>was exercised during the food\u2019s preparation. Perhaps this is the way one must act today even according to <strong>Shul\u1e25an Arukh<\/strong>, because all industrially produced foods contain a variety of ingredients, and there is concern that one of them is not kosher for Pesa\u1e25. Therefore, during Pesa\u1e25, one must be careful not to eat any factory food products that are not certified kosher for Pesa\u1e25.<\/p>\n<p>Where the facts of a case are not in doubt, there are still often practical differences between the rulings of <strong>Shul\u1e25an Arukh <\/strong>and Rema. Although fundamentally the law accords with <strong>Shul\u1e25an Arukh<\/strong>, the tendency today is to be stringent so that food will be kosher for all communities. This is the appropriate practice when it is not overly difficult to be stringent. However, when stringency causes significant loss, there are grounds to encourage those who follow <strong>Shul\u1e25an Arukh<\/strong> and the majority of <strong>poskim<\/strong> to continue following their practice.<sup><a href='#_te01ftn8_5' id='_te01ftnref8_5' class='aup1'>[5]<\/a><\/sup><\/p>\n<div>\n<hr size=\"1\" \/>\n<div>\n<a href='#_te01ftnref8_5' id='_te01ftn8_5'>[5]<\/a>. The issue of <strong>\u1e25ozer ve-ne\u2019or <\/strong>lies at the heart of this question. Those who are stringent are concerned that a crumb of <strong>\u1e25ametz<\/strong> fell into a food before Pesa\u1e25, and that when Pesa\u1e25 begins <strong>\u1e25ametz<\/strong> \u201creawakens\u201d and causes the entire mixture to become forbidden (Rema 447:4 based on several Ashkenazic Rishonim, and Radbaz 1:487). However, according to the opinion that <strong>\u1e25ametz <\/strong>is not <strong>\u1e25ozer ve-ne\u2019or<\/strong>, even if a crumb had fallen into the mixture, it would have been <strong>batel <\/strong>before Pesa\u1e25 and does not reawaken on Pesa\u1e25. Moreover, <strong>Pri \u1e24adash<\/strong> states that even according to the opinion that <strong>\u1e25ametz <\/strong>is <strong>\u1e25ozer ve-ne\u2019or <\/strong>there is room to be lenient in this case, since there is no reason to suspect that a crumb of <strong>\u1e25ametz<\/strong> fell into the mixture. Furthermore, all agree that the prohibition of eating a food into which a drop of <strong>\u1e25ametz<\/strong> fell is rabbinic, and according to <strong>She\u2019iltot<\/strong>, even <strong>\u1e25ametz <\/strong>is <strong>batel be-shishim<\/strong>.<\/p>\n<p>There is another concern that one cooked the food in <strong>\u1e25ametz<\/strong> utensils, and it absorbed some of the <strong>\u1e25ametz<\/strong> taste from the <strong>kelim<\/strong>. However, those who are lenient hold that there is no reason to suspect this, since it is assumed that most <strong>kelim<\/strong> have not been used within 24 hours and would then not influence the taste of the dish in a positive way (and would not make the dish prohibited). Furthermore, even if the <strong>kelim<\/strong> had been used within 24 hours of cooking the dish, <strong>\u1e25ametz<\/strong> before Pesa\u1e25 is permissible, thus the cooked dish is a \u201c<strong>nat bar nat\u201d<\/strong> (the pot absorbed the taste of the <strong>\u1e25ametz<\/strong> and in turn, passed the taste on to the cooked dish) of permissible food, which is permitted; and see <strong>Ye\u1e25aveh Da\u2019at<\/strong> 1, 11 and in the notes. This fundamental dispute hinges on other issues, such as whether sharp food (<strong>davar \u1e25arif<\/strong>) restores and improves the taste absorbed in the <strong>kelim<\/strong>.
