Similarly, he may not recite <i>Birkot HaTorah<\/i> since he already fulfilled his obligation by saying <i>Ahavat Olam.<\/i> Also, he may not recite <i>Elokai Neshamah<\/i>, since there are those who say that he already fulfilled his obligation to recite <i>Elokai Neshamah<\/i> when he recited <i>Birkat<\/i> <i>Mechayei hameitim<\/i> in the <i>Amidah<\/i>.<\/p>\n<p>Therefore, one who must skip <i>Birkot HaShachar<\/i> in order to pray in a <i>minyan<\/i> on time should at least recite <i>Al netilat yadayim<\/i>, <i>Elokai Neshamah<\/i>, and <i>Birkot HaTorah<\/i> first, because if he does not recite them first, he will not be able to make them up after the prayer service (<i>Mishnah Berurah<\/i> 52:2).<sup><a id=\"_te02ftnref9_2\" class=\"aup1\" href=\"#_te02ftn9_2\">[2]<\/a><\/sup><\/p>\n<p>Until when may he recite them? Since there are those who equate the time to recite the <i>berachot<\/i> to the time of the <i>Amidah<\/i>, <i>l&#8217;chatchilah<\/i> he should try to recite them before the first four hours of the day have passed, and <i>b\u2019dieved<\/i> until <i>chatzot<\/i> (halachic noon). However, if he did not succeed in saying them before <i>chatzot<\/i>, <i>b\u2019dieved<\/i> he may recite them the whole day. The reason for this is that according to the majority of <i>poskim<\/i>, the time to say the <i>berachot<\/i> differs from the time to recite <i>Shacharit<\/i>, because <i>Birkot HaShachar<\/i> are blessings of thanks for the good things from which people derive pleasure throughout the day.<sup><a id=\"_te02ftnref9_3\" class=\"aup1\" href=\"#_te02ftn9_3\">[3]<\/a><\/sup><\/p>\n<div>\n<hr size=\"1\" \/>\n<div><a id=\"_te02ftn9_2\" href=\"#_te02ftnref9_2\">[2]<\/a>.\u00a0For a more extensive outline of the laws of<i> Birkot HaTorah<\/i>, see further in this book, 10:2 and note 2. Concerning <i>Elokai Neshamah<\/i>, the <i>Mishnah Berurah<\/i> 52:9 and <i>Bei\u2019ur Halachah<\/i> write that the <i>Pri Chadash<\/i> maintains that one fulfills his obligation by reciting <i>Birkat<\/i> <i>Mechayei hameitim<\/i>. The <i>Chayei Adam<\/i> and <i>Derech HaChaim<\/i> quote him. However, <i>Ma\u2019amar Mordechai<\/i> disagrees with him. That is also what the <i>Pri Megadim<\/i> understands from the <i>Rama<\/i>\u2019s words, and what we can infer from the <i>Gra<\/i>\u2019s writings. In any case, in order to avoid uncertainty, one who skips <i>Birkot HaShachar<\/i> in order to pray in a <i>minyan<\/i> should first recite <i>Elokai Neshamah<\/i>. If he did not recite it, he may not recite it after the prayer service, for <i>safek berachot l\u2019hakel<\/i>, (when there is doubt regarding the recital of <i>berachot<\/i> we are lenient). However, the <i>Bei\u2019ur Halachah<\/i> writes that one may rely on all of the <i>poskim<\/i> who maintain that one may recite <i>Elokai Neshamah<\/i> after the prayer service. Further, the <i>Mishnah Berurah<\/i> writes that if he explicitly has <i>kavanah<\/i> in <i>Birkat<\/i> <i>Mechayei hameitim<\/i> not to fulfill his obligation for saying <i>Elokai Neshamah<\/i>, he does not fulfill it and he may recite it after the prayer service. However, the <i>Yechaveh Da\u2019at<\/i> 4:5, in the footnote, writes that this <i>kavanah<\/i> does not help. According to this, if, in the middle of saying <i>Birkot Keriat Shema<\/i>, he remembers that he did not recite <i>Birkot HaShachar<\/i>, he should recite <i>Elokai Neshamah<\/i> even between the <i>berachot<\/i>, so as not to miss out on saying it altogether (<i>Yalkut Yosef<\/i> 46:23-24).<\/div>\n<div><a id=\"_te02ftn9_3\" href=\"#_te02ftnref9_3\">[3]<\/a>.\u00a0The <i>Derech HaChaim<\/i>, based on the <i>Magen Avraham<\/i>, writes that the laws of <i>Birkot HaShachar<\/i> are equal to the laws of the <i>Amidah<\/i>, and just as the time of the <i>Amidah<\/i> lasts four proportional hours, which is a third of the day, so does the time to recite <i>Birkot HaShachar<\/i>. There are those who maintain that just as <i>b\u2019dieved<\/i> one may recite <i>Shacharit <\/i>until <i>chatzot<\/i> (halachic noon), the same is true for <i>Birkot HaShachar<\/i> (Rabbi Shlomo Kluger). <i>Kaf HaChaim<\/i> 71:4 writes that if one already prayed <i>Shacharit<\/i> he may recite <i>Birkot HaShachar<\/i> within the first four hours of the day, and if he did not yet pray <i>Shacharit<\/i>, he may recite them until <i>chatzot<\/i>. However, according to the majority of <i>poskim<\/i>, <i>Birkot HaShachar<\/i> are not directly linked to prayer, and one who forgets to recite them in the morning may recite them the entire day, and that is what is written in <i>Mishnah Berurah<\/i> 52:10 and <i>Rav Pe\u2019alim<\/i> 2, <i>Orach Chaim<\/i> 8. (According to the <i>Gra<\/i>, if one forgot to recite them during the day, he may say them even at night until he goes to sleep.
