According to the Rosh<\/i> and most of the Rishonim<\/i>, one who was awake all night, as on Shavuot night, may not recite Birkot HaTorah<\/i> before Shacharit<\/i>, because as long as he did not interrupt by sleeping, the previous day\u2019s Birkot HaTorah<\/i> still apply. That is how many eminent Acharonim<\/i> rule (Pri Chadash<\/i>, Gra<\/i>, Chayei Adam<\/i>). According to Rabbeinu Tam<\/i>, however, he must recite Birkot HaTorah<\/i> before Shacharit<\/i>. Since Birkot HaTorah <\/i>are intended to last for a 24-hour period, even if he did not sleep at all during that whole day, when the time arrives to recite Shacharit<\/i> the next day, he must recite Birkot HaTorah<\/i> again. That is what is said in the name of the Arizal<\/i>, and that is the minhag<\/i> of the Sephardim<\/i> (Birkei Yosef<\/i> 46:12; Ben Ish Chai<\/i>, Berachah<\/i> 3; Kaf HaChaim<\/i> 47:26).<\/p>\n
In order to avoid uncertainty, it is preferable that someone who did not sleep at night hear someone else recite Birkot HaTorah<\/i>, <\/i>thereby fulfilling his obligation according to all opinions.<\/p>\n
If he cannot find someone who needs to recite Birkot HaTorah<\/i>, according to the minhag<\/i> of the Sephardim<\/i> and some of the Ashkenazim<\/i>, he should recite Birkot HaTorah<\/i> himself. According to the minhag<\/i> of the majority of Ashkenazim<\/i>, he should have kavanah<\/i> to fulfill the obligation of Birkot HaTorah<\/i> in Ahavah Rabbah<\/i> before Shema<\/i> (Mishnah Berurah<\/i> 47:28), for we have already learned (in halachah 2) that this berachah<\/i> is considered like Birkot HaTorah<\/i>. After praying he must learn a verse of scripture or a Mishnah<\/i> in order to adjoin his learning to the berachah<\/i>.[8]<\/a><\/sup><\/p>\n Regarding that same person who stayed awake all night, if he slept a regular sleep during the day prior to that, according to all opinions he must recite Birkot HaTorah<\/i> before reciting Shacharit<\/i>.[9]<\/a><\/sup>\u00a0(See earlier in this book 9:6 for a summary of the laws concerning one who was awake all night.)<\/p>\n
