{"id":6154,"date":"2010-01-10T07:00:25","date_gmt":"2010-01-10T05:00:25","guid":{"rendered":"https:\/\/ph.yhb.org.il\/en\/?p=6154"},"modified":"2018-05-24T11:25:37","modified_gmt":"2018-05-24T08:25:37","slug":"02-10-07","status":"publish","type":"post","link":"https:\/\/ph.yhb.org.il\/en\/02-10-07\/","title":{"rendered":"07 &#8211; One Who Was Awake All Night"},"content":{"rendered":"<p>According to the <i>Rosh<\/i> and most of the <i>Rishonim<\/i>, one who was awake all night, as on Shavuot night, may not recite <i>Birkot HaTorah<\/i> before <i>Shacharit<\/i>, because as long as he did not interrupt by sleeping, the previous day\u2019s <i>Birkot HaTorah<\/i> still apply. That is how many eminent <i>Acharonim<\/i> rule (<i>Pri Chadash<\/i>, <i>Gra<\/i>, <i>Chayei Adam<\/i>). According to <i>Rabbeinu Tam<\/i>, however, he must recite <i>Birkot HaTorah<\/i> before <i>Shacharit<\/i>. Since <i>Birkot HaTorah <\/i>are intended to last for a 24-hour period, even if he did not sleep at all during that whole day, when the time arrives to recite <i>Shacharit<\/i> the next day, he must recite <i>Birkot HaTorah<\/i> again. That is what is said in the name of the <i>Arizal<\/i>, and that is the <i>minhag<\/i> of the <i>Sephardim<\/i> (<i>Birkei Yosef<\/i> 46:12; <i>Ben Ish Chai<\/i>, <i>Berachah<\/i> 3; <i>Kaf HaChaim<\/i> 47:26).<\/p>\n<p>In order to avoid uncertainty, it is preferable that someone who did not sleep at night hear someone else recite <i>Birkot HaTorah<\/i>,<i> <\/i>thereby fulfilling his obligation according to all opinions.<\/p>\n<p>If he cannot find someone who needs to recite <i>Birkot HaTorah<\/i>, according to the <i>minhag<\/i> of the <i>Sephardim<\/i> and some of the <i>Ashkenazim<\/i>, he should recite <i>Birkot HaTorah<\/i> himself. According to the <i>minhag<\/i> of the majority of <i>Ashkenazim<\/i>, he should have <i>kavanah<\/i> to fulfill the obligation of <i>Birkot HaTorah<\/i> in <i>Ahavah Rabbah<\/i> before <i>Shema<\/i> (<i>Mishnah Berurah<\/i> 47:28), for we have already learned (in halachah 2) that this <i>berachah<\/i> is considered like <i>Birkot HaTorah<\/i>. After praying he must learn a verse of scripture or a <i>Mishnah<\/i> in order to adjoin his learning to the <i>berachah<\/i>.<sup><a id=\"_te02ftnref10_8\" class=\"aup1\" href=\"#_te02ftn10_8\">[8]<\/a><\/sup><\/p>\n<p>Regarding that same person who stayed awake all night, if he slept a regular sleep during the day prior to that, according to all opinions he must recite <i>Birkot HaTorah<\/i> before reciting <i>Shacharit<\/i>.<sup><a id=\"_te02ftnref10_9\" class=\"aup1\" href=\"#_te02ftn10_9\">[9]<\/a><\/sup>\u00a0(See earlier in this book 9:6 for a summary of the laws concerning one who was awake all night.)<\/p>\n<div>\n<hr size=\"1\" \/>\n<div>\n<p><a id=\"_te02ftn10_8\" href=\"#_te02ftnref10_8\">[8]<\/a>.\u00a0<span style=\"font-size: 16px\">This is the Sephardic<\/span><i style=\"font-size: 16px\"> minhag<\/i><span style=\"font-size: 16px\">, based on <\/span><i style=\"font-size: 16px\">Rabbeinu Tam<\/i><span style=\"font-size: 16px\">. One who was awake all night must be careful not to recite <\/span><i style=\"font-size: 16px\">Birkot HaTorah<\/i><span style=\"font-size: 16px\"> before <\/span><i style=\"font-size: 16px\">amud hashachar<\/i><span style=\"font-size: 16px\">. <\/span><i style=\"font-size: 16px\">Shut HaElef Lecha Shlomo <\/i><span style=\"font-size: 16px\">33 writes that if he recited them before <\/span><i style=\"font-size: 16px\">amud hashachar<\/i><span style=\"font-size: 16px\"> his <\/span><i style=\"font-size: 16px\">berachah<\/i><span style=\"font-size: 16px\"> is in vain and it must be repeated after <\/span><i style=\"font-size: 16px\">amud hashachar<\/i><span style=\"font-size: 16px\">. That is also what is written in <\/span><i style=\"font-size: 16px\">Kaf Hachaim <\/i><span style=\"font-size: 16px\">47:29. The <\/span><i style=\"font-size: 16px\">Tzlach <\/i><span style=\"font-size: 16px\">in <\/span><i style=\"font-size: 16px\">Berachot<\/i><span style=\"font-size: 16px\"> 11b is uncertain of this, and therefore the <\/span><i style=\"font-size: 16px\">Yalkut Yosef<\/i><span style=\"font-size: 16px\"> 47:9 writes that if he recites the <\/span><i style=\"font-size: 16px\">berachah<\/i><span style=\"font-size: 16px\"> before <\/span><i style=\"font-size: 16px\">amud hashachar<\/i><span style=\"font-size: 16px\">, he should have <\/span><i style=\"font-size: 16px\">kavanah<\/i><span style=\"font-size: 16px\"> to fulfill his obligation in <\/span><i style=\"font-size: 16px\">Ahavat Olam<\/i><span style=\"font-size: 16px\">. (According to the <\/span><i style=\"font-size: 16px\">Ben Ish Chai<\/i><span style=\"font-size: 16px\">, those who are awake all night should recite <\/span><i style=\"font-size: 16px\">Birkot HaShachar<\/i><span style=\"font-size: 16px\"> immediately after <\/span><i style=\"font-size: 16px\">chatzot<\/i><span style=\"font-size: 16px\"> and only delay the recital of <\/span><i style=\"font-size: 16px\">Birkot HaTorah<\/i><span style=\"font-size: 16px\"> until after <\/span><i style=\"font-size: 16px\">amud hashachar<\/i><span style=\"font-size: 16px\">.)<\/span>Concerning the Ashkenazic custom, the <i>Mishnah Berurah<\/i> writes that if one is not in the vicinity of someone whom he can hear recite <i>Birkot HaTorah<\/i>, he can have <i>kavanah<\/i> to fulfill his obligation in <i>Ahavah Rabbah.<\/i> That is based on the <i>Chayei Adam<\/i> in the name of <i>Pri Chadash<\/i> and the <i>Gra.<\/i> It is also the prevalent <i>minhag<\/i>. However, according to the <i>Magen Avraham<\/i>, <i>Derech HaChaim<\/i>, <i>Eliyah Rabbah<\/i>, and <i>Shulchan Aruch HaRav<\/i> 7, he should recite the blessings himself. That is what is written in <i>Olat Ra\u2019ayah<\/i> p. 59, as well. The reason for this is because the obligation to recite the <i>berachot<\/i> is biblical and <i>sefeika d\u2019oriata l\u2019chumra<\/i>, (when there is doubt concerning biblical obligations, we are stringent). Obviously, one who wishes to rely on them is permitted to do so.<\/p>\n<\/div>\n<div><a id=\"_te02ftn10_9\" href=\"#_te02ftnref10_9\">[9]<\/a>.\u00a0So writes <i>Mishnah Berurah<\/i> 47:28, according to Rabbi Akiva Eiger, that in this case, all <i>poskim<\/i> agree that one must recite <i>Birkot HaTorah<\/i>.
