{"id":6253,"date":"2010-01-15T08:00:25","date_gmt":"2010-01-15T06:00:25","guid":{"rendered":"https:\/\/ph.yhb.org.il\/en\/?p=6253"},"modified":"2018-05-24T11:38:37","modified_gmt":"2018-05-24T08:38:37","slug":"02-15-08","status":"publish","type":"post","link":"https:\/\/ph.yhb.org.il\/en\/02-15-08\/","title":{"rendered":"08 &#8211; Mitzvot Require Kavanah"},"content":{"rendered":"<p>The <i>Amora\u2019im<\/i> and the <i>Rishonim<\/i> disagree regarding the question, do <i>mitzvot<\/i> require <i>kavanah<\/i>? When the Torah commands us to perform a certain mitzvah, is the actual performance enough, or must a person have in mind the correct intent in order to fulfill the commandment? The halachah rules that <i>mitzvot<\/i> require <i>kavanah<\/i>. Just as a person has a body and a soul and one cannot live without the other, so too, the <i>mitzvot<\/i> need both body and soul, the body being the act of the mitzvah, and the soul being the <i>kavanah<\/i> that accompanies it.<\/p>\n<p>Therefore, regarding a person who is reading the Torah portion of <i>Parashat<\/i> <i>Va\u2019etchanan<\/i>, in which the <i>Shema<\/i> paragraph is written: when the time to recite <i>Shema<\/i> arrives, if he has <i>kavanah<\/i> in his heart to fulfill the mitzvah of reciting<i> Shema<\/i>, he has fulfilled his obligation. However, if he continues reading as he was, without having <i>kavanah<\/i> to fulfill the mitzvah of saying <i>Shema<\/i>, he has not fulfilled his obligation (<i>Berachot<\/i> 13a; <i>Shulchan Aruch<\/i> 60:4).<\/p>\n<p>It is therefore apparent that when reciting <i>Shema<\/i>, we must concentrate on two meanings. First, as with all the <i>mitzvot<\/i>, we must have in mind that in performing this act, we are fulfilling Hashem\u2019s commandment. Second, pertinent specifically to the mitzvah of reciting <i>Shema<\/i>, we must concentrate on the meaning of the words that we are saying. Since the essence of this mitzvah is to accept the yoke of Heaven, we are obligated to focus on the meaning of our words. As we have learned in halachah 6, if one did not concentrate on the meaning of the words in the verse <i>Shema<\/i> <i>Yisrael<\/i>, he did not fulfill his obligation and must go back and read it with the required <i>kavanah<\/i>.<\/p>\n<p>We will now return to discuss the general <i>kavanah<\/i> required in the performance of all the <i>mitzvot<\/i>. Sometimes, one has implicit <i>kavanah<\/i>, and that suffices <i>b\u2019dieved<\/i>. For instance, a person who comes to pray in a synagogue, and in his prayers he recites the <i>Shema<\/i> paragraph, even though he did not explicitly intend to perform the mitzvah of reciting <i>Shema<\/i>, he fulfilled his obligation. For if we were to ask him, \u201cWhy did you say <i>Shema<\/i>?\u201d he would immediately answer, \u201cTo perform the mitzvah.\u201d Thus, in his recital he had implicit <i>kavanah<\/i> to fulfill his obligation. Similarly, someone who puts on <i>tefillin<\/i>, even though he didn\u2019t meditate on what he was doing, it is nonetheless clear that his only intention could have been to fulfill the mitzvah, and because implicit <i>kavanah<\/i> was present, he fulfilled his obligation (<i>Yerushalmi Pesachim<\/i> 10:3; <i>Chayei Adam<\/i> 68:9; <i>Mishnah Berurah<\/i> 60:10).<sup><a id=\"_te02ftnref15_5\" class=\"aup1\" href=\"#_te02ftn15_5\">[5]<\/a><\/sup><\/p>\n<p>Many people do not know that the main reason for the recital of the <i>Vayomer<\/i> paragraph is to fulfill the commandment of remembering the Exodus from Egypt, which is mentioned at the end of the paragraph. Those unaware of this fact do not fulfill their obligation. For even if we were to ask them why they said the <i>Vayomer<\/i> paragraph, they would not know that it was in order to remember the Exodus. Apparently, there was not even implicit <i>kavanah<\/i> within them. Therefore, it is important to teach that the reason for the recital of the <i>Vayomer<\/i> paragraph is to remember the Exodus from Egypt.<\/p>\n<div>\n<hr size=\"1\" \/>\n<div>\n<p><a id=\"_te02ftn15_5\" href=\"#_te02ftnref15_5\">[5]<\/a>.\u00a0<span style=\"font-size: 16px\">Likewise, a person who comes to synagogue to hear the blowing of the s<\/span><i style=\"font-size: 16px\">hofar<\/i><span style=\"font-size: 16px\">, or the reading of the <\/span><i style=\"font-size: 16px\">megillah<\/i><span style=\"font-size: 16px\">, even though he did not explicitly have <\/span><i style=\"font-size: 16px\">kavanah<\/i><span style=\"font-size: 16px\"> to fulfill the mitzvah, he fulfilled his obligation <\/span><i style=\"font-size: 16px\">b\u2019dieved<\/i><span style=\"font-size: 16px\">, for the fact that he arrived at the synagogue indicates his desire to fulfill the mitzvah, and that he had implicit <\/span><i style=\"font-size: 16px\">kavanah<\/i><span style=\"font-size: 16px\">. However, if he was in his house and he heard the <\/span><i style=\"font-size: 16px\">shofar<\/i><span style=\"font-size: 16px\"> being blown, or the <\/span><i style=\"font-size: 16px\">megillah<\/i><span style=\"font-size: 16px\"> being read from the synagogue, and he did not explicitly have in mind to fulfill the mitzvah, he did not fulfill his obligation. Nevertheless, according to those <\/span><i style=\"font-size: 16px\">poskim<\/i><span style=\"font-size: 16px\"> who believe that <\/span><i style=\"font-size: 16px\">mitzvot<\/i><span style=\"font-size: 16px\"> do not require <\/span><i style=\"font-size: 16px\">kavanah<\/i><span style=\"font-size: 16px\">, he did fulfill his obligation.<\/span>The origin of the disagreement can be found in <i>Berachot<\/i> 13a and <i>Rosh<\/i> <i>Hashanah<\/i> 28-29a. According to Rava, <i>mitzvot<\/i> do not require <i>kavanah<\/i>; however, Rabbi Zeira is of the opinion that <i>mitzvot<\/i> do need <i>kavanah<\/i>. The following are the opinions of a few of the <i>poskim<\/i>: the <i>Tosafot<\/i> and <i>Talmidei<\/i> <i>Rabbeinu<\/i> <i>Yonah<\/i> write that <i>mitzvot<\/i> do not require <i>kavanah<\/i>, in contrast to the <i>Ba\u2019al Halachot Gedolot<\/i>, <i>Rif<\/i>, and <i>Rosh<\/i> who maintain that <i>mitzvot<\/i> do require <i>kavanah<\/i>. That is also how the <i>Shulchan<\/i> <i>Aruch<\/i>, <i>Orach<\/i> <i>Chaim<\/i> 60:4, rules. The <i>Bei\u2019ur<\/i> <i>Halachah<\/i> explains that even those who maintain that <i>mitzvot<\/i> do not need <i>kavanah<\/i> still assert that two other conditions must be present: 1) when he is performing the mitzvah the person must know that such a mitzvah exists; for example, to recite <i>Shema<\/i> or eat matzah. If he knew this and at that particular moment he did not have even implicit <i>kavanah<\/i> to fulfill the mitzvah, according to them, he still fulfilled his obligation. 2) He must have in mind to perform the act and cannot be like a <i>mitasek<\/i> \u2013 one who is merely busying himself. In other words, if he unthinkably puffed into the <i>shofar<\/i> and kosher sounds came out, he did not fulfill the obligation of the mitzvah.<\/p>\n<p>Further, there is dispute as to whether lack of <i>kavanah<\/i> in performing rabbinic commandments prevents a person from fulfilling his obligation. The <i>Magen<\/i> <i>Avraham<\/i> writes in the name of the <i>Radbaz<\/i> that the lack of <i>kavanah<\/i> while performing rabbinic commandments does not prevent a person from fulfilling the mitzvah. His reasoning is that we are unsure as to whom the halachah follows, and therefore, concerning biblical commandments we go according to those <i>poskim<\/i> who are stringent, and regarding rabbinic commandments we follow those who are lenient. However, according to the <i>Eliyah<\/i> <i>Rabbah<\/i>, <i>Gra<\/i>, and <i>Chida<\/i>, rabbinic commandments also require <i>kavanah<\/i>, and that is what is implied in the <i>Shulchan<\/i> <i>Aruch<\/i>. In any case, regarding <i>berachot<\/i> (even those recited on biblical commandments) we take into consideration those <i>poskim<\/i> who believe that <i>mitzvot<\/i> do not require <i>kavanah<\/i>, since \u201c<i>safek<\/i> <i>berachot<\/i> <i>l\u2019hakel<\/i>\u201d \u2013 if there is doubt regarding the recital of <i>berachot<\/i>, we are lenient. Therefore, a person who did not have <i>kavanah<\/i> at the start, although required to go back and fulfill the mitzvah, he may not recite the blessing again due to the uncertainty that perhaps the halachah goes according to those who maintain that <i>mitzvot<\/i> do not require <i>kavanah<\/i> (<i>Mishnah<\/i> <i>Berurah<\/i> 60:10 and <i>Bei\u2019ur<\/i> <i>Halachah <\/i>there).<\/p>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The Amora\u2019im and the Rishonim disagree regarding the question, do mitzvot require kavanah?
