{"id":6399,"date":"2010-01-19T04:00:22","date_gmt":"2010-01-19T02:00:22","guid":{"rendered":"https:\/\/ph.yhb.org.il\/en\/?p=6399"},"modified":"2018-05-24T12:05:49","modified_gmt":"2018-05-24T09:05:49","slug":"02-19-04","status":"publish","type":"post","link":"https:\/\/ph.yhb.org.il\/en\/02-19-04\/","title":{"rendered":"04 &#8211; Must Nine Men Respond to Chazarat HaShatz?"},"content":{"rendered":"<p>When the <i>chazan<\/i> repeats the <i>Amidah<\/i>, each and every congregant must be silent, have <i>kavanah<\/i> to hear the <i>chazan<\/i>\u2019s <i>berachot<\/i>, and answer <i>Amen<\/i> to them all. We have already mentioned the opinion (in the laws of the <i>minyan<\/i>, 2:7) that the <i>chazan<\/i> is prohibited from starting to recite the <i>Amidah<\/i> repetition until there are nine men who will respond <i>Amen<\/i> to his <i>berachot<\/i>. Others say that even if a few members of the <i>minyan<\/i> are still praying the <i>Amidah<\/i>, although they cannot answer <i>Amen<\/i>, they are counted as part of the <i>minyan<\/i>.<\/p>\n<p><i>L\u2019chatchilah<\/i>, it is customary for the <i>chazan<\/i> to be stringent and not start reciting the <i>Amidah<\/i> repetition until nine men are available to answer <i>Amen<\/i> after him. In extenuating circumstances, when there are people who are in a rush to conclude the prayer service, and it seems that the person extending his <i>Amidah<\/i> is not about to finish, it is permissible to rely on the opinion of most <i>poskim<\/i> and start <i>Chazarat HaShatz<\/i> when only eight people have concluded the <i>Amidah<\/i>. When this is impossible because there are a number of people prolonging their <i>Amidah<\/i>, if the situation is extremely mitigating, it is permissible to be lenient and begin the <i>Amidah<\/i> repetition when only five have finished praying, for together with the <i>chazan<\/i> they comprise the majority of a <i>minyan<\/i>. In order to avoid uncertainty, if it is necessary to begin the <i>Amidah<\/i> repetition when there are not yet nine people able to answer, the <i>chazan<\/i> makes a stipulation in his heart before praying. He stipulates that if the law follows those who maintain that there must be nine who answer, his prayer is voluntary (<i>tefillat nedavah<\/i>). Since a person is permitted to pray voluntarily, according to all opinions his <i>berachot<\/i> will not be in vain.<\/p>\n<p>Similarly, one who is leading the prayer service in a place in which many people normally chatter, so much so that there is doubt as to whether will be nine men there to respond <i>Amen<\/i> to his <i>berachot<\/i>, he makes a stipulation in his heart before the repetition, that if the law follows those who maintain that there must be nine who answer, if there are not nine, his prayer is voluntary.<\/p>\n<p>In order not to enter into such uncertainty, every person who hears <i>Chazarat HaShatz <\/i>must presume that without him there are not nine men; he must concentrate on the <i>chazan<\/i>\u2019s <i>berachot<\/i> and respond <i>Amen<\/i> to them (<i>Shulchan Aruch<\/i> 124:4).<sup><a id=\"_te02ftnref19_3\" class=\"aup1\" href=\"#_te02ftn19_3\">[3]<\/a><\/sup><\/p>\n<div>\n<hr size=\"1\" \/>\n<div><a id=\"_te02ftn19_3\" href=\"#_te02ftnref19_3\">[3]<\/a>.\u00a0<span style=\"font-size: 16px\">The dispute of the <\/span><i style=\"font-size: 16px\">Acharonim<\/i><span style=\"font-size: 16px\"> as to whether nine people are needed in order to respond to the <\/span><i style=\"font-size: 16px\">Amidah<\/i><span style=\"font-size: 16px\"> repetition is clarified by the <\/span><i style=\"font-size: 16px\">Shulchan Aruch<\/i><span style=\"font-size: 16px\">,<\/span><i style=\"font-size: 16px\"> Orach Chaim<\/i><span style=\"font-size: 16px\"> 55:6-8 and 124:4, and in its commentaries. A summary is presented earlier in this book in the laws of the <\/span><i style=\"font-size: 16px\">minyan<\/i><span style=\"font-size: 16px\">, chapter 2:7. <\/span><i style=\"font-size: 16px\">L&#8217;chatchilah<\/i><span style=\"font-size: 16px\">, we are stringent like the opinion of the <\/span><i style=\"font-size: 16px\">Graz<\/i><span style=\"font-size: 16px\"> and the <\/span><i style=\"font-size: 16px\">Ben Ish Chai<\/i><span style=\"font-size: 16px\">. However, in extenuating circumstances we may be lenient, for that is the opinion of most <\/span><i style=\"font-size: 16px\">poskim<\/i><span style=\"font-size: 16px\">, among them <\/span><i style=\"font-size: 16px\">Tzitz Eliezer<\/i><span style=\"font-size: 16px\"> 12:9 and <\/span><i style=\"font-size: 16px\">Yalkut Yosef<\/i><span style=\"font-size: 16px\"> 124:14-18. Even when a person who is in the middle of his <\/span><i style=\"font-size: 16px\">Amidah<\/i><span style=\"font-size: 16px\"> is included as one of the <\/span><i style=\"font-size: 16px\">minyan<\/i><span style=\"font-size: 16px\">, there is disagreement as to whether up to four may be counted, or only one, as brought by the <\/span><i style=\"font-size: 16px\">Mishnah Berurah<\/i><span style=\"font-size: 16px\"> 55:32.
