What is the Law Be-di\u2019avad?"},"content":{"rendered":"<p align=\"left\"><span style=\"margin: 0px;font-family: 'Times New Roman',serif\"><span style=\"color: #000000\">If one recited the <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">Amida<\/span><\/i><span style=\"color: #000000\"> within four <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">amot<\/span><\/i><span style=\"color: #000000\"> of feces, she did not fulfill her obligation, and the <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">Amida <\/span><\/i><span style=\"color: #000000\">must be repeated<\/span><i><span style=\"color: #000000;font-family: Times New Roman\">. <\/span><\/i><span style=\"color: #000000\">Even if she was unaware that there was excrement there, but there was a reasonable concern that the place would contain excrement, she acted negligently by not examining the cleanliness of the place before praying, and therefore she did not fulfill her obligation. However, if the place was unlikely to contain excrement, since she was not required to check, she fulfilled her obligation (SA 76:8; MB 76:31 and 81:13). <\/span><\/span><\/p>\n<p align=\"left\"><span style=\"margin: 0px;font-family: 'Times New Roman',serif\"><span style=\"color: #000000\">The <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">poskim<\/span><\/i><span style=\"color: #000000\"> disagree about one who recited <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">berakhot<\/span><\/i><span style=\"color: #000000\"> within four <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">amot<\/span><\/i><span style=\"color: #000000\"> of excrement. Some say that because she transgressed a biblical prohibition, she did not fulfill her obligation and must repeat all the <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">berakhot<\/span><\/i><span style=\"color: #000000\"> (MB 185:7; BHL <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">ad loc.<\/span><\/i><span style=\"color: #000000\">). Others maintain that the Sages are only strict about the recitation of <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">Shema<\/span><\/i><span style=\"color: #000000\"> and the <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">Amida<\/span><\/i><span style=\"color: #000000\">, but concerning other <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">berakhot<\/span><\/i><span style=\"color: #000000\">, <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">be-di\u2019avad<\/span><\/i><span style=\"color: #000000\"> she fulfilled her obligation (<\/span><i><span style=\"color: #000000;font-family: Times New Roman\">\u0124ayei Adam <\/span><\/i><span style=\"color: #000000\">3:33; <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">Kitzur <\/span><\/i><span style=\"color: #000000\">SA 5:10; <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">Kaf Ha-\u0125ayim <\/span><\/i><span style=\"color: #000000\">76:37, 185:14). Since this is a matter of dispute concerning <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">berakhot<\/span><\/i><span style=\"color: #000000\">, and repeating the <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">berakha<\/span><\/i><span style=\"color: #000000\"> raises concerns about making a <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">berakha le-vatala<\/span><\/i><span style=\"color: #000000\">, the principle of leniency in matters of uncertainty about <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">berakhot <\/span><\/i><span style=\"color: #000000\">(\u201c<\/span><i><span style=\"color: #000000;font-family: Times New Roman\">safek berakhot le-hakel<\/span><\/i><span style=\"color: #000000\">\u201d) applies, and she may not repeat the <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">berakha<\/span><\/i><span style=\"color: #000000\">. It is best that she meditates on the words of the <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">berakha<\/span><\/i><span style=\"color: #000000\">, for some <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">poskim<\/span><\/i><span style=\"color: #000000\"> maintain that one fulfills the obligation to recite a <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">berakha<\/span><\/i><span style=\"color: #000000\"> just by thinking it (Rambam), and the prohibition to recite a <\/span><i><span style=\"color: #000000;font-family: Times New Roman\">berakha le-vatala<\/span><\/i><span style=\"color: #000000\"> does not apply to thought.<\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>If one recited the Amida within four amot of feces, she did not fulfill her obligation, and the Amida must be repeated.
