{"id":5887,"date":"2018-04-16T00:01:14","date_gmt":"2018-04-15T21:01:14","guid":{"rendered":"https:\/\/ph.yhb.org.il\/es\/?p=5887"},"modified":"2025-05-19T12:11:16","modified_gmt":"2025-05-19T09:11:16","slug":"17-16-01","status":"publish","type":"post","link":"https:\/\/ph.yhb.org.il\/es\/17-16-01\/","title":{"rendered":"01- Los l\u00edmites del precepto"},"content":{"rendered":"<p>Quien se encuentra con un nido y desea tomar a la madre que se halla sobre los polluelos o sobre los huevos a fin de ingerir su carne \u2013 no tendr\u00e1 permitido hacerlo, ya que la Tor\u00e1 orden\u00f3 que no se puede aprovechar la responsabilidad de la madre por cuidar a sus polluelos o a sus huevos para cazarla, sino que se la deber\u00e1 ahuyentar para que vuele y no intente regresar al nido, y solamente despu\u00e9s se podr\u00e1 intentar atraparla como al resto de las aves. Asimismo, estar\u00e1 prohibido tomar los polluelos o los huevos mientras la madre yazca sobre ellos, pudiendo hacerlo \u00fanicamente despu\u00e9s de haberla ahuyentado a una distancia tal que resulte imposible atraparla. Tal como fue dicho (Devarim-Deuteronomio 22:6-7): <em>\u201c<\/em><em>Si apareciere un nido de p\u00e1jaros ante ti<\/em><em>, en el camino, en cualquier \u00e1rbol, o sobre la tierra: polluelos o huevos, y la madre yace sobre los polluelos o sobre los huevos, no habr\u00e1s de tomar la madre junto con las cr\u00edas. Liberar habr\u00e1s de liberar a la madre y a las cr\u00edas podr\u00e1s tomar para ti; ya que va a ser bien para ti y prolongar\u00e1s tus d\u00edas\u201d<\/em>.<\/p>\n<p>El precepto aplica sobre las diferentes especies de aves aptas para su ingesti\u00f3n, las cuales suelen ser tomadas como alimento. Pero en el caso de las aves impuras, est\u00e1 permitido tomar a la madre junto con los huevos y los polluelos (Shulj\u00e1n Aruj 292:1).<\/p>\n<p>El precepto rige \u00fanicamente para aquellas aves silvestres que no son propiedad del ser humano, tal como fue dicho: <em>\u201cSi apareciere un nido de p\u00e1jaros ante ti\u201d<\/em>, en un sitio que no le pertenece a nadie. Pero en el caso de un nido que es propiedad de alguien esta prohibici\u00f3n no rige, pues tanto la madre como los huevos y los polluelos son del propietario, y por ende, puede tomarlos cuando desee (Mishn\u00e1 Tratado de Jul\u00edn 138:2). Por lo tanto, si bien la gallina es un ave, quien la cr\u00eda puede tomarla cuando yazca sobre sus huevos, as\u00ed como tambi\u00e9n a los polluelos o a los huevos que se incuban bajo ella. Otro tanto ocurre en el caso de las palomas que son propiedad de un individuo, este tendr\u00e1 permitido tomarlas sin restricci\u00f3n.<\/p>\n<p>En caso de que alguien transgrediese tomando a la madre mientras yace sobre los polluelos, sobre los huevos o sobrevolando sobre estos &#8211; deber\u00e1 liberarla y as\u00ed reparar\u00e1 su pecado.
